Effective date: September 8, 2026
1.1.These Website Terms of Use (“Terms”) set out the conditions on which Birch Labs B.V. (“Birch Labs”) permits use of its website, including its content and features (“Website”).
1.2.The Service Agreement governs applications for and provision of services and use of client reports, including the status and effect of the Engagement Terms. These Terms do not amend the Service Agreement. Acceptance of these Terms does not conclude a service agreement.
1.3.If you accept these Terms on behalf of an organization, you confirm that you are authorized to bind that organization.
1.4.The Privacy Notice explains how Birch Labs processes personal data.
2.1.You may browse public pages, use public features for their stated purposes, link to public pages, and save or print material for ordinary personal or internal business use. Retain any attribution and rights notices when copying material.
2.2.Search engines, AI assistants and other automated agents may crawl, retrieve, index and summarize public pages for search, discovery and answering users’ questions, including through background crawling and indexing. They may store copies and create searchable indexes and retrieval collections reasonably necessary for those purposes, and display links and brief excerpts with attribution to Birch Labs. These permissions do not authorize training or fine-tuning AI or other machine-learning models.
2.3.These permissions are subject to Articles 3 and 4 and any published crawler instructions, rate limits and access restrictions. Permission to retrieve material does not authorize other uses of that material.
3.1.You must not carry out or arrange any of the following, whether manually, through automated systems or through another person:
(a)access non-public areas, systems or material without authorization, or use another person’s credentials without Birch Labs’ authorization;
(b)circumvent access controls, rate limits or restrictions, including by changing accounts, identities or network addresses;
(c)disrupt, overload or impair the Website or its supporting systems, or introduce malware or other harmful code;
(d)submit deliberately false or misleading information, impersonate another person, falsely suggest affiliation with or endorsement by Birch Labs, or use forms or other features for unsolicited bulk communications;
(e)conduct vulnerability scanning or penetration testing without Birch Labs’ prior written permission; or
(f)systematically probe, reverse engineer or extract information to discover or reconstruct non-public code, prompts, methods, decision rules, configurations or datasets without Birch Labs’ prior written permission.
3.2.Security concerns may be reported using the contact details below. Reporting a concern does not itself authorize testing or further access.
4.1.Intellectual property rights in Website material remain with Birch Labs or the relevant rights holders. Apart from the uses permitted by Article 2, you may not reproduce, republish, sell or otherwise exploit protected Website material, or systematically extract Website material to build a reusable content collection or substitute for the Website or its materials, without Birch Labs’ prior written permission.
4.2.Except for the uses expressly permitted by Article 2 or by Birch Labs in writing, Birch Labs expressly reserves its rights in Website material for the purposes of Article 15o of the Dutch Copyright Act (Auteurswet) and the corresponding provisions of the Dutch Database Act (Databankenwet). You must not carry out text and data mining of Website material outside those permitted uses, or use Website material to train or fine-tune AI or other machine-learning models, or to build datasets for those training or fine-tuning purposes, without Birch Labs’ prior written permission.
4.3.Nothing in these Terms restricts lawful quotation or criticism, independent development, or any right or exception that cannot lawfully be excluded or restricted. No ownership is claimed over unprotected facts or ideas.
5.1.Website information is general information. It does not constitute legal, tax, investment or other professional advice, an audit or assurance opinion, certification or regulatory approval. It is not a substitute for an assessment of your circumstances.
5.2.Birch Labs does not guarantee that general Website information is complete, current or suitable for a particular purpose, or that the Website will be continuously available or free from errors. Birch Labs may change or discontinue Website content or features.
5.3.This Article does not affect obligations under a concluded Service Agreement or exclude or limit liability that cannot lawfully be excluded or limited.
6.1.Birch Labs may restrict or withdraw Website access to protect the Website or respond to actual or reasonably suspected misuse. This does not release Birch Labs from obligations under a concluded Service Agreement.
6.2.Birch Labs may preserve evidence of misuse and pursue available legal remedies, including an injunction, a court-ordered penalty for non-compliance with an injunction, compensation for recoverable loss and legally recoverable costs.
6.3.Birch Labs may publish updated Terms with the date of the update. Updates apply prospectively, subject to any acceptance or notice required by law.
6.4.These Terms are governed by Dutch law. Disputes arising from or in connection with these Terms are subject to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands. Consumers retain any applicable mandatory protections under the law of their habitual residence and any mandatory rights to bring or defend proceedings in another court. Either party may seek interim protective measures from another competent court.
